ELIGIBILITY
The TMG#3 Giveaway ("Giveaway" or "Promotion") is exclusively open to legal residents of the 49 contiguous United States (excluding AK), the District of Columbia, and Canada (excluding Quebec), who are licensed drivers and of legal age of majority in their respective state/province/territory of residence. Employees of TUNER MERCH LLC ("Sponsor"), its affiliates, subsidiaries, advertising partners, internet agencies, and their immediate family members (spouse, parent, child, sibling, and grandparent), as well as those residing in the same household, are ineligible. The Giveaway is void in AK, HI, Quebec, and where prohibited by law. All federal, state, provincial, municipal, and local laws and regulations apply. Entrants agree to abide by these Official Rules by participating in the Giveaway. Winning a prize is subject to meeting all outlined requirements herein.

The Sweepstakes begins at 12:00:01 pm. EST on August 17, 2025 and ends at 11:59:59 pm. EST on January 18, 2026, or once a total of 2,000 entries have been received, whichever occurs first (the “Sweepstakes Period”). The Sponsor’s database computer will serve as the official time-keeping device for the Sweepstakes.

Method of Entry: Eligible entrants will automatically receive entries based on qualifying purchases made at www.tuner-merch.com during the Sweepstakes Period:

• One (1) Shirt = One (1) Entry

• One (1) Hoodie = Three (3) Entries

• One (1) Hat = Two (2) Entries

• One (1) Digital Download = One (1) Entry

• Digital Promo: Purchase Five (5) Entries, Receive One (1) Bonus Entry (Total = Six (6) Entries)

 
NOTE: ANY FRAUDULENT ACTIVITY IN CONNECTION WITH THIS SWEEPSTAKES IS STRICTLY PROHIBITED.  IT IS FRAUDULENT TO PURCHASE TICKETS/ITEMS TO OBTAIN ENTRIES WITH THE INTENT TO RETURN THESE ITEMS AFTER THE SWEEPSTAKES ENDS.  IF THE SPONSOR IDENTIFIES OR SUSPECTS THAT YOU ARE ENGAGED IN THIS OR ANY OTHER FRAUDULENT ACTIVITY, YOU WILL BE DISQUALIFIED AND BANNED FROM ANY FURTHER SWEEPSTAKES OFFERED BY THE SPONSOR.

THIRD: Via Mail-In Entry
During the Sweepstakes Period, entrants may obtain one (1) entry only by mailing a hand-printed request. To do so, clearly print your full name, complete mailing address, phone number, date of birth, and email address on a 3” x 5” card or piece of paper. Place the card in a #10 business-sized envelope with proper postage and mail to:

All mail-in entries must be postmarked by December 26, 2025 and received by January 10, 2026 to be eligible.

Important Notes:

• The entry card must be hand-printed by the entrant only.

• Use of any third-party, automated service, or bulk submission will void the entry.

• Incomplete, illegible, late, or non-compliant entries will not receive an entry.

• No confirmation of receipt will be provided.

you must be at least 18 years old or have reached the age of majority in your respective state or province of permanent residence at the time of entry. However, employees, officers, and representatives of the Sponsor, the Administrator, their respective parent companies, advertising, and promotional agencies, as well as immediate family members or individuals residing in the same household as these individuals, including biological, adoptive, and step-parents, grandparents, siblings, children, and grandchildren, are not allowed to participate in the Giveaway. Please meet the eligibility criteria or comply with any of the rules stated in this document to avoid disqualification. This giveaway is invalid in Puerto Rico, U.S. territories, and locations where it is prohibited or limited by law. (To make it clear, any mentions in these regulations of "Entrants" also refer to the winning entrant as defined below.)

By participating, entrants agree to the Sponsor's collection and use of their information and acknowledge having read and accepted the Sponsor's Privacy Policy

Fraudulent activity, including purchasing items to obtain entries with the intent to return them after the promotion, is strictly prohibited ALL SALES ARE FINAL. Such actions will result in disqualification and a ban from all future Giveaways or promotions offered by Tuner Merch.



RELEASE AND LIMITATIONS OF LIABILITY
By entering the Giveaway, entrants agree to release and hold harmless the Sponsor, from any claims or actions arising from participation or use of the Prize. This includes, but is not limited to:
* Technical difficulties preventing entry submission,
* Unauthorized human intervention,
* Printing errors,
* Administrative or entry processing errors, and
* Injury, death, or property damage resulting from participation or winning the Grand Prize.
The Released Parties are not liable for errors, omissions, interruptions, deletions, defects, delays, communication failures, theft, destruction, unauthorized access to, or alteration of entries. They are also not responsible for technical malfunctions of telephone networks or lines, computer systems, servers, providers, equipment, software, or any email or entry failures due to technical issues, human error, or internet congestion.
Entrants agree that in any legal action, the Released Parties' liability will be limited to the cost of participating in the Giveaway, excluding attorney fees or punitive, consequential, direct, or indirect damages.

Except as expressly stated, the Released Parties will not be liable for any losses or damages, including direct, indirect, incidental, consequential, or punitive damages, arising from participation in the Sweepstakes or from accepting, possessing, using, or misusing a Prize. Entrants agree to release and indemnify the Released Parties from any liability for injuries, death, losses, or damages to persons or property, as well as for claims based on defamation, invasion of privacy, or publicity rights arising from participating in the Sweepstakes or its related activities, or from accepting, possessing, using, or misusing a Prize. The Released Parties are not responsible if the Giveaway is canceled due to weather, fire, strike, acts of war or terrorism, pandemic, or any other condition beyond their control.

RELEASE OF CLAIMS (CALIFORNIA)
Entrants acknowledge the possibility of unknown claims at the time of agreeing to these Official Rules and entering the Sweepstakes. Entrants assume the risk associated with such unknown claims and expressly waive any rights under California Civil Code Section 1542 and any similar federal or state law. Section 1542 states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would materially affect his or her settlement with the debtor or released party.”

GENERAL CONDITIONS
If the operation or administration of the Giveaway is impaired by computer viruses, tampering, fraud, technical difficulties, or other causes beyond the Sponsor's control, the Sponsor reserves the right to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Giveaway. The Sponsor also reserves the right to award the Prizes using all non-suspect eligible entries received up to the cancellation, termination, modification, or suspension date.
Intentionally damaging a website or interfering with the lawful operation of the Giveaway is illegal and subject to criminal and civil penalties. The Sponsor may seek damages or legal remedies from responsible parties as permitted by law.

Failure to enforce any provision of these Official Rules does not constitute a waiver of that provision. If a dispute arises regarding the identity of a Winner based on an email address, the Sponsor will consider the entry submitted by the authorized account holder of the email address used to enter. The "authorized account holder" is the individual assigned the email address by the relevant Internet or online service provider or other organization responsible for assigning email addresses for the domain.

1st place Pre-owned 1991 NISSAN 240SX SILEIGHTY with approximately 5000 MILES ON THE ENGINE BUILD WITH AN ESTIMATED VALUE OF $18,000-$20,000 OR the winner may decline and can choose our CASH OUT OPTION AT $15,000 USD.

The Grand Winner must title the vehicle within 15 days of receiving the CAR.

The Prize will be delivered "AS IS," and any upgrades or additional options are the Winner's responsibility. The Sponsor is not liable for any warranty, representation, or guarantee regarding the vehicle's quality, fitness for purpose, or mechanical condition. The Winner must have a valid U.S. driver's license and provide necessary documentation to avoid prize forfeiture and selection of an alternate winner.If the announced Prize is unavailable, the Sponsor reserves the right to substitute a prize of equal or greater value.

PRIZE CONDITIONS
The Prize Winner must release and hold harmless the Released Parties, their related companies, officers, directors, employees, shareholders, and agents from any claims or actions arising from participation in the Sweepstakes or the use of the Prize. The potential Winner must sign and return to the Administrator an Affidavit of Eligibility and Liability/Publicity Release (for U.S. residents) or a Declaration of Compliance (for Canadian residents) within five days of notification to claim the Prize. The Affidavit requires the Winner to provide their Social Security Number for tax purposes. The Winner is responsible for local, state, and federal taxes on the Prize, which is considered taxable income, and the IRS will file a Form 1099 in the Winner's name. The Winner is solely responsible for the Prize after receipt. If a Prize or notification is returned unclaimed or undeliverable, or if the potential Winner fails to comply with the rules, an alternate Winner may be selected.

The winner will be contacted by phone live after the drawing ,if the winner did not answer we will send them a text or email at the Sponsor's discretion and try to call them again.We will never ask for any sort of payments to claim your winning prize . The winner agrees to allow the Released Parties to use their name, image, voice, and biographical data for advertising and promotional purposes without further compensation if permitted by law. By participating, entrants agree to release and hold harmless the Released Parties from liability for injuries, death, or damages to persons or property. The Released Parties are not responsible for any warranty, representation, or guarantee relating to the prize, express or implied.

DISPUTES
By participating, entrants agree to resolve any disputes individually, without class action, and limit claims, judgments, and awards to actual costs incurred, excluding attorney fees. Entrants waive all rights to punitive, incidental, consequential, or other damages except out-of-pocket expenses. The validity, interpretation, and enforceability of these Official Rules and the rights and obligations of Entrants, Sponsors, and Released Parties are governed by Florida law. Legal proceedings related to the Giveaway or these Official Rules must be held in federal or state courts in Clearwater, California. If any provision is deemed invalid or unenforceable, the remaining provisions remain in effect.

SEVERABILITY
If any part of these Official Rules is found invalid or unenforceable, it does not affect the validity or enforceability of the remaining parts. The other provisions remain in effect as if the invalid part was not included.

MISCELLANEOUS
These rules represent the complete and final agreement regarding the Sweepstakes and override prior agreements. Section headings are for convenience and do not affect the rules. Changes or waivers must be in writing and signed by the Sponsor and Administrator. The release of any rule does not waive other provisions. Entrants cannot transfer rights and responsibilities without written consent, and such attempts are void. These rules bind the Sponsor, Administrator, Entrant, and their successors and assigns.

The verified winner's name will be posted on our FB/IG Profile @Tunermerch after complete verification.

By providing information, you agree to provide accurate, complete, and true information and not use a false name.

Our mobile messaging program allows users to receive messages by opting in, and you agree to these terms by participating. You consent to receive automated or prerecorded marketing messages and understand that consent is not required for purchase. To opt out, reply STOP to any message from us. Message frequency varies, and standard message and data rates apply. You must have a compatible wireless device and service. If under 13, do not use the program. If between 13 and 18, you must have parental consent. By participating, you agree to these terms and our Privacy Policy.

This Giveaway is not sponsored, endorsed, or administered by any social media platforms, search engines, tech companies, or prize manufacturers. None of these entities have endorsed or recommended this Giveaway in any way.
